Terms of Service
These terms govern your use of CounterQuotes — the estimating, scheduling, and CRM service at counterquotes.com and your shop's yourshop.counterquotes.com address. By using the service you agree to them. They're written in plain language on purpose.
1. A young product
CounterQuotes is newly launched. Features are still landing quickly, and the pricing shown on our site is the current plan. There is no formal uptime guarantee yet, though we run the service carefully and keep regular backups: it runs a working granite shop every day, including ours.
2. Your account
- You're responsible for the people you add to your shop and what they do with their access.
- Keep your credentials to yourself; passkeys are supported and recommended.
- Tell us right away if you think an account has been compromised.
3. Your data
- You own your business data — quotes, drawings, customers, price lists, schedules, all of it.
- We use it only to run the service for you, as described in our Privacy Policy.
- If you leave, ask and we'll export your data in a usable format, then delete it.
4. Your quotes are still your quotes
CounterQuotes computes prices from the drawings, price lists, and rules your shop configures. You're responsible for reviewing what you send to your customers — the numbers on a quote are your shop's business decision, not ours.
5. Fees & billing
- Paid plans are billed per seat, in advance, at the prices shown when you sign up — monthly, or annually at a discount if you choose the pay-the-year option. Your first month is free — a card is required to start, and billing begins when the trial ends unless you cancel first.
- Payments are processed by Stripe; your card details go to Stripe directly and we never see or store them.
- You can manage seats, update your card, or cancel anytime in Settings → Billing. Added seats are prorated from the day you add them. Dropped seats stay active through the period you've already paid — there's no partial credit. Cancellation takes effect at the end of the current billing period.
- Annual plans are paid up front for the full year and are non-refundable. Seat reductions and a switch back to monthly billing can be scheduled anytime, but take effect when the paid year ends — until then you keep, and pay for, the seats you bought. Seat additions still apply (and prorate) immediately.
- If a payment fails we'll retry and let you know before anything is suspended.
- Prices don't include any sales tax we're required to collect — where applicable, it's added at checkout.
- If prices change, existing shops get at least 30 days' notice, never mid-cycle.
6. Acceptable use
- Don't attempt to access another shop's data or probe the service for weaknesses.
- Don't use the service for anything unlawful, or resell access to it.
- Don't send spam through it.
7. Third-party connections
If you connect QuickBooks or other integrations, those services' own terms apply to their side, and you authorize us to exchange the data the integration needs.
8. Disclaimers & liability
The service is provided as-is, without warranties. To the fullest extent the law allows, our total liability for any claim is limited to the amount you paid us in the twelve months before the claim. Nothing here limits liability that can't legally be limited.
9. Ending things
You can stop using the service and close your account at any time — your data-export right in §3 applies. We may suspend or end accounts that break these terms, and we'll warn you first unless the situation makes that unreasonable.
10. Changes
We'll update these terms as the product matures — the "last updated" date above will change, and active shops will be told directly about material changes. Using the service after a change means you accept it.
11. Governing law
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute that can't be resolved informally will be handled in the state or federal courts located in Marion County, Florida, and both sides consent to that venue.
